Difference between passing off and infringement (Para 44)
Once the trade marks are identical, the court cannot see whether the infringement is likely to deceive or cause confusion. (Para 54) Injunction is to be issued immediately once it is proved that the defendant improperly used the plaintiff’s trade mark
